Defence

Roles and Responsibilities

The main role of a defence team is to work on behalf of their client to get their charges reduced or if possible get their charges withdrawn. A defence team consists of a legal executive, solicitor and a barrister. The legal executive if the person in which the defended will go to and present there situation, it is than the legal executives decision whether to take on the case if they do they than inform the solicitor. The solicitor than prepares for the trial in court and deal with the client. A criminal solicitor works on behalf of their client to ensure that their client is being treated fairly and justly, they also offer the best possible advice for their client in order to proceed with their case. Criminal solicitors also interview witnesses and collect and collate evidence. However in court the solicitor sits behind the barrister  as it is the barrister who represents the defendant, however they do not actually engage with the client. Solicitors call on barristers in a higher profile
case, especially within serious criminal law cases, this is because of their experience and enhanced understand of the law. Barristers are a crucial part of the hearing in a trial and the sentencing process for both the defense and the prosecution sides of the trail.

The O.J. Simpson Case

For the murder trial of Nicole Brown and Ronald Goldman, O.J.Simpson's defence team was made up of Johnnie Cochran, Robert Kardashian, Robert Shapiro Lee Bailey and Alan Dershowitz. Together they were known as 'The Dream Team', a name given to them by the media. Throughout the trail within court, Johnnie Cochran was O.J.Simpsons main lawyer. Within the court it was Cochran who provoked the prosecution to ask Simpson to try on the glove. When the glove did not fit on Simpsons hand Cochran's replied with the famous words:
"If it does not fit, you must acquit."

Cochran also presented in court that O.J.Simpson had been set up by members of the investigation team such as Mark Fuhrman, for planting evidence such as O.J.Simpsons blood on vital evidence and at the crime scene itself.
